ORDINANCE NO. 2016-BC-0-02 AN ORDINANCE AMENDING THE OFFICIAL ZONE MAP AS TO CERTAIN REAL ESTATE WITHIN THE COUNTY OF MADISON, INDIANA, AS HEREIN DESCRIBED WHEREAS, an Ordinance has been referred to the duly authorized Plan Commission of Madison County, Indiana, for a change in the Official Zone Map as to certain real estate in said County as hereinafter described; and WHEREAS, the Madison County Planning Commission has given proper notice and conducted a public hearing for this Ordinance and, thereafter, made a favorable recommendation to the Board of Commissioners of Madison County, Indiana on March 8, 2016; being Petition #2016-Z-001. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MADISON COUNTY, INDIANA, UNDER THE AUTHORITY OF INDIANA CODE ^36-7-4-608 AND ALL ACTS AMENDATORY THERETO, AS FOLLOWS: SECTION 1. That Zoning Ordinance No. 2002-BC-06 of Madison County, Indiana, as shown by the records of Madison County, Indiana, be amended to change the Zone Map as incorporated therein and the following legally described real estate in Madison County, Indiana, to-wit: A part of the Northwest Quarter of Section 17, Township 19 North, Range 7 East located in Stony Creek Township, Madison County, Indiana being described as follows: Commencing at a point on the north line of Section 17, Township 19 North, Range 7 East, said point being 1446.74 feet West of the northeast corner of the Northwest Quarter of the Northeast Quarter of said Section 17, and running thence West 518.26 feet along said north line; thence turn an angle to the left, 89 degrees and 10 minutes, ans measure Southerly 453.00 feet along a property line fence to the POINT OF BEGINNING of this description; thence continue Southerly 336.20 feet along a property line fence; thence Easterly 518.26 feet parallel with the north line of said Section 17; thence Northerly 336.20 feet; thence Westerly 518.26 feet parallel with the north line of said Section 17 to the POINT OF BEGINNING. Containing 4.00 acres, more or less, being subject to all applicable easements and rights-of-way of record. The above description was written based upon the record description, Instrument Number 2010R009848, and is not based upon a field survey. Be and the same is hereby rezoned from the present zoning of (AG) Agriculture to (GC) General Commercial. The subject property is located on the north side of SR 32 approximately 1/2 mile west of Layton Road, Madison County, Indiana, consisting of 4 acres, more or less at the northern most edge of their current GC Zoning line. Address 4570 W SR 32, Anderson, IN 46011. SECTION 2. This Ordinance shall be in full force and effect from and after its passage by the Commissioners of Madison County, Indiana, and publication as by law provided. Passed and adopted by the Board of Commissioners of Madison County, Indiana, this 15th day of March, 2016.
